| 摘 要： | 恶意欠薪行为直接侵害民事领域中的劳动关系。无论是从刑法谦抑性精神去权衡,还是从恶意欠薪行为的实质及刑法的保护机能等分析,对该行为入罪的定位都有失准确。调整并健全现有法律法规,加强执行力,即可有力打击该恶意行为,保护劳动者的合法权益。

| Abstract: | Malicious arrears of wages infringed directly labor relations in civil fields.Analyzed from the limited criminal sanction,the essence of acts or the function of criminal law,in my opinion,viewing the acts as crime is beneath accuracy.Perfecting the present laws and regulations and strengthening the weak executive power can not only attack the law-breaking acts,but protect the legitimate right of the labors. |
