| 摘 要： | 《物权法》颁布和实施后，我国抵押权制度有了重大改进，但仍存在诸多有待完善之处，如：法律适用和配套问题亟待解决，关于抵押权存续期间的规定不利于抵押权人权利的实行，抵押权实行的方式不够完善，未真正建立抵押权的追及效力制度等。我国应借鉴国外立法，尽快完善有关抵押权实行的制度，包括制定相关配套法律，增加抵押权实行方式的规定，确立抵押权追及效力及涤除权的保护制度等。

| Abstract: | Since the ＂Property law＂ was implemented, China＇s mortgage system has been greatly improved, but it has much room for further improvement. Such problems as law application and matching measures have to be settled urgently, the way to practise mortgage is not sound enough, and the system of the efficacy of claim of mortgage has not been really established. So the country should draw on overseas legislation, improve its systems regading practising mortgage, and set up a protection system for the efficacy of claim of mortgage and the elimination right. |
