| 摘 要： | 刑事证据开示因其共同的价值基础而在英美法系、大陆法系和我国普遍存在。各国不同的刑事诉讼体制决定了刑事证据开示方式和范围的差异 ,刑事证据开示所依托的程序在多数国家都存在且有所区别。我国现行的刑事证据开示与刑事诉讼体制、庭审方式不相适应 ,因而需要改进。

| Abstract: | The discovery of criminal evidence has a value basis in Anglo-American law system and civil law county and our county.Different criminal litigation system decide the difference of way and range in the discovery of criminal evedence.the discovery of crimimal evidence procedure is present and different in majority counties,In our country,the discovery of crimimal evidence needs being improved because it is not suit to criminal procedure system and mode of trial. |
