我国行政合同的适用范围及相关问题探析

行政合同是现代行政法上被广泛运用的一种新型管理手段。我国的行政合同在理论、立法、司法及实践运用中都存在许多问题。其根源在于行政合同理论体系尚未建立 ,许多基础理论尚不充分。本人拟从行政合同的产生及我国和国外在理论及实践中对适用范围的规定入手 ,并结合几个相关问题的探讨 ,力图寻找行政合同的适用空间 ,并认为应以此去构建我国行政合同理论体系及制定一部行政合同法。

Expound Range of Application of Chinese Administrative Contract

The administrative contract is a new type of adminitration which can be used widly.But in our China,there are many defects in the theory,legislation,justice and practical operation in administrative contracts,which result from the imperfection of the system and the fundemental theory.We try to seek the limits of application,through analyzing the producing of this kind of contracts and the limits of application in China and other counties.In addition,some related problems are also be explained.This can help us to form a better theory system and make us work out an administrative contrct law in the future.
