中外反商业贿赂立法的比较与思考

天津德普“回扣门”事件暴露出我国对商业贿赂罪的立法存在着缺陷和不足，主要体现在对商业贿赂的法律规定过于简约和原则，没有形成一个结构合理、衔接得当的反商业贿赂法律体系，且立法较为滞后、轻缓和混乱。为此，我国应当尽快制定统一的《反商业贿赂法》，构建新的商业贿赂罪名体系，填补公司、企业中非国家工作人员间接受贿的立法空白。
