| 摘 要： | 贷款诈骗犯罪是司法实践中多发性犯罪之一。目前司法实践中对某些问题尚存争议,本文认为首先应当在立法上完善贷款诈骗罪的犯罪主体;其次,＂非法占有目的＂应当是本罪必要的构成要件。再次,对＂其他方法＂的理解应当贯穿于贷款合同的签订和履行的全过程。

| Abstract: | Loan swindling is one of frequent crimes in judicial practice.The author thought subject of crime of loan swindling should be improved first in legislation.Then the aim of possessing illegally should be necessary element of the crime.Next,the understanding to the words "with other ways" should go through the whole process of making contract and performing it. |
