“5·12”大地震对世界遗产的影响及法律保护新思考

＂5·12＂四川汶川特大地震在造成巨大人员伤亡和财产损失的同时,也对西部珍贵的世界文化和自然遗产造成了前所未有的破坏。其中,世界自然遗产＂四川大熊猫栖息地＂生态资源遭受极大破坏,有被列入《濒危世界遗产名录》的危险。汶川地震在对西部珍贵的世界遗产造成了前所未有的破坏的同时,也给西部申遗带来了新机遇。突如其来的灾难让我们为毁损世界遗产惋惜的同时,也对世界遗产保护有关的法律、法规提出了新的思考。建议在世界遗产保护法中增加预防和应对地震等灾害毁损世界遗产的法条,或者制定颁布《地震、水灾等自然灾害对策法》、《应对地震、水灾等自然灾害保护世界遗产条例》等法律法规。

The Influence of the Earthquake at May 12 to the World Heritage and the Legal Thoughts

Many people and the property were destroyed by the Wenchuan earthquake of Sichuan province at May 12,Which made the world precious culture and the natural heritage in the west district of China destroyed at the same time.The zoology resource of the habitat of the giant panda in Sichuan province which belongs to the world natural heritage was destroyed,which had the danger of being written to the items of the world precious heritage.While the world precious heritage in the west district of China was destroyed,I find the new opportunity of declaring the heritage at the same time.While we feel sorry for the world heritage which was destroyed,I analyze that two measures should be done in order to protect the world heritage.Firstly,It is the measure of adding the rule of preventing and dealing with the earthquake which destroys the world heritage and so on in the protection law of the world heritage;Secondly,It is the measure of formulating the law Which includes the countermeasure law of natural disaster including the earthquake and the flood and so on,the ordinance of protecting the world heritage in order to deal with the natural disaster Which includes the earthquake and the flood and so on.
