| 摘 要： | 传统中国衙门的公堂之上普遍悬挂"明镜高悬"匾额,有着颇为丰富的文化内涵。本文拟在"凡俗与神圣"的文化脉络中,来解读其中蕴含的司法精神与司法理想。一方面,"明镜高悬"彰显了传统中国司法实践的核心价值,即实现"实质正义"的理想;另一方面,也表达了实现"实质正义"的基本进路,即司法官员不但要有"仁恕哀矜"的道德情感,而且要有"明察秋毫"的司法能力,以使案件真相大白,最终实现司法正义。因此,在公堂上彰显"明镜"的神性力量和象征意义,既延伸了司法官员的能力,又起到了约束司法官员的功能,更产生了威慑原被两造的作用。
