论我国的违宪审查条款--兼评《立法法》第90条与相关法律的衔接

本文运用类比分析法对我国违宪审查条款进行解析并得出结论 :“不适当”是“抵触”的上位概念 ;“决定命令”隐含抽象和具体双重涵义。针对结论之外凸显的实体与程序规定的疏忽进行了反思。实体规定上 ,作者反思了法律违宪和《宪法》第 10 4条的缺陷 ;程序规定上 ,作者认为 ,《立法法》虽纠正了《全国人大组织法》的违宪之处但又遗留了新问题。作者建议 ,一方面对现行法律违宪审查应探索新的方式 ,另一方面适当地修正《立法法》有关规定。

On the Clauses of Reviewing the Breach of Our Constitution

WT5BZ]The article analyzes the clauses reviewing the breach of constitution by means of analyzing analogy and draws the conclusion that the concept `inappropriateness' is more general than`incompatibility',and the phrase decision and order'implies both abstract and concrete meanings.Then the author reviews the negligence of the substantive and procedural.As to the substantive provision,the author probes into the case where the law breahes the constitution and.the defects of Art.104 of the constitution.As to the procedural provision,the author thinks that,though The Legislation Act"corrects some cases where NPCC Organization Act conflicts with the constitution,some new problems arises.Finally,the author proposes that,on the one hand,we should try to find the new ways of reviewing of the law violating the constitution,and on the other hand,amend the relevant provisions of The Legislation Act.
