| 摘 要： | 添附是所有权取得的一种方法，其与侵权并不是一一对应的关系，在许多情形下，可能只构成添附而不构成侵权。即使既构成添附又构成侵权的情形，添附也有独立存在的必要。基于物尽其用、增进社会财富的需要，我国物权立法应该规定添附制度。

| Abstract: | Accretion is achieved by a method of ownership,and is not a one-to-one relationship with the infringement.In many cases,it may constitute an infringement rather than accretion.Even if both accretion also constitute an infringement case,accretion is also necessary for independent existence.Based on as far as possible with the needs of the promotion of social wealth,our property rights legislation should set forth the accretion system. |
