关于交通肇事逃逸行为主观目的的辩证思考

我国刑法将交通肇事逃逸行为作为交通肇事罪的加重情节,但是,对于逃逸行为主观目的如何理解在我国目前尚存在争议。争议的焦点在于逃逸是为了逃避法律追究亦或为了逃避救助伤者的义务。从交通肇事者具有的救助伤者义务、交通肇事者逃避法律追究的期待可能性、逃逸行为的立法目的及保障司法实践的公平合理等方面入手分析,可以得出交通肇事逃逸行为的主观目的应是指为了逃避救助伤者的义务。

Dialectic Thinking on Subjective Purpose of Escape Behavior of Causing Traffic Accidents

Escape behavior of causing traffic accidents is acted as the aggravating circumstances of the crime of causing traffic accidents,however,the interpretation of subjective purpose of escape behavior in our country at present still controversial.The focus of controversy is that the purpose of escape behavior is to escape legal action or to escape the obligation to rescue the injured.Perpetrators of the traffic have the obligation to rescue the injured and expected possibility to avoid legal action,the legislative intent of escape behavior and ensure judicial practice fair and reasonable.From the above analysis,we can conclude that the subjective purpose of escape behavior of causing traffic accidents is to escape the obligation to rescue the injured.
