海峡两岸跨区犯罪执行程序若干问题

为了遏制犯罪,维护"一国两制"下的社会繁荣与稳定,有必要建立有利于区域经济发展的法律制度和区际司法协助制度,就跨法域犯罪的特定对象的情报通报、交换,代为取证,代为送达刑事法律文书,协助缉捕移交案犯,代为执行相互请求的刑事裁决.根据海峡两岸刑事犯罪的特点和存在问题,对待两地犯罪的执行,应当坚持我国区际刑事司法协助所应当遵循的原则,坚持和发展依靠民间组织的中介作用推动两地犯罪执行程序建设的做法,探索判决裁定的互相承认问题.并从有利于被判刑人的改造、减少司法成本、保障被判刑人的合法权益等角度,探索已决犯的移管问题和执行完毕的通报.

Several Issues on Execution Procedure concerning Cross Taiwan Channel Crimes

In order to restrain the crime and maintain social prosperity and stability under "one country, two systems", it is of necessity to establish a legal system and interregional judicial cooperation system which benefit the development of regional economy, to notify and communicate the information of specific object concerning cross-jurisdiction crimes, obtain evidences for and serve criminal legal documentations with each other, assist the other side to arrest and extradite the criminals, and execute criminal judgment requested by the other side. According to the characteristics and problems of the crimes of both sides of the Taiwan channel, the execution procedure should conform to the principles applied in Chinese interregional criminal judicial cooperation, persist in and develop the method employing the intermediary function of the civilian organizations to promote the advancement of execution procedure of both sides, and search after the matter of mutual acknowledge of the judgments. In addition, it is important to study issues on the transfer and administration of the convicted and the notification of the end of execution from aspects of reforming the convicted, reducing judicial costs, and safeguarding legal rights and interests of the criminals.
