| 摘 要： | 社会主义新农村建设不仅是反哺农村,更重要的是在制度上赋予农民转换身份的自由,使农民真正成为一项职业而非身份.农村土地承包经营权流转问题,对限制的理由予以反驳,并揭示该问题背后所蕴含的集体与农民的定位,由此对《物权法》第128条进行相应的分析与建议.

| Abstract: | The new rural reconstruction not only means to return nurturing to the countryside,but also entrusts with the farmer to the freedom of transforming the status. Scholars have different views of the quality of the land contract managerial authority.In Property Right Law,the land contract managerial authority in the country is prescribed as usufructuary right,but it is limited from circulation.Based on the 128th article of Property Right Law,there is some corresponding analysis and the suggestion. |
