| Abstract: | Base on the discussion of the legal elements of the procedure of an action to have the claim confirmed, and according to practice , the paper studies five legal issues of the action to have the claim confirmed: the nature and the scope of the trial in the action to have the claim confirmed; jurisdiction of the action to have the claim confirmed; the interpretation and properly apply the article 90 of Maritime Procedure Law of PRC; the legal issues caused by applying Civil Procedure of PRC in the action to have the claim confirmed; the special questions of marine insurer to bring an action to have the claim confirmed. |
