| 摘 要： | 考试法上的判断余地是指在国家统一考试的阅卷过程中存在的,具备行政权力特征、专属于考试主体、只受有限司法审查的高度属人性判断。法律适用过程中的不确定法律概念导致了考试判断余地的产生,其类型包括雷同卷的判断与评分的判断。考试判断余地并非绝对排除司法审查,一旦产生法定瑕疵,就应当受到全面的审查。
