| 摘 要： | 两大法系都存在处于民法生活序列中私人财产权与国家财产权中间过渡阶段的公用领域,但其法理解释和制度构建却有明显的差异。按照权益标准对公用资源进行分割并在此基础上构建权利人对公用资源的支配关系具有借鉴价值和意义。

| Abstract: | There are the special common realm ,lying between private property and state property ,in both the American and Continental laws. But there is a lot of difference in the theoretic interpretability and institutional construction. It is of significance that the property right is endowed based of segmentation in rights and interests. |
