我国非犯罪化的立法路径

当前，我国犯罪一直呈上升态势，刑事司法工作压力巨大。在“宽严相济”刑事政策指导下，研究非犯罪化的立法路径对我国刑法体系的完善和刑事司法实践具有重要的理论价值和现实意义。刑法的进步和完善应遵循犯罪化和非犯罪化的双向思维模式。非犯罪化的立法路径是探讨如何在立法层面实现我国刑法的非犯罪化。我国非犯罪化的立法路径可从四方面进行设计：一是活化传统容隐制度；二是强化“但书”的出罪机能；三是增设正当化事由：四是确立无被害人犯罪的非犯罪化。

Legislative Route of Decriminalization in China

At present, the crime rate in China is rising continually, so that criminal judicature is under great pressure. Under the guidance of the criminal policy of ＂combination of leniency and strictness＂, it is of great importance for the perfection of criminal law and practice of criminal justice of China to study the ap- proach of decriminalization. The improvement and perfection of criminal law should be attained through the two- way thinking mode, taking both criminalization and decriminalization into consideration. Legislation on decrimi- nalization means how to realize decriminalization through legislative approach. It can be designed through the following ways： firstly, practicing mutual concealment of offenses among the kin, secondly, intensifying the effect of the salvo, thirdly, adding justifiable reasons and fourthly, establishing the decriminalization of victim- less crime.
