On Some Legal Issues Relating to Charter Party Arbitration Clause Incorporated in the Bills of Lading

In view of some legal issues relating to charter party arbitration clause incorporated in a bill of lading in maritime judicial practice of China such as whether the charter party has been incorporated into a bill of lading or not, whether the transferee of bill of lading is a party to the incorporation clause, law applicable in determining the validity of arbitration clause, etc, this article puts forward some constructive advice through analyzing different views in accordance with the basic principles of evidence law, maritime law, civil law and international private law.
