论保险合同之法定解除权

2009年2月28日，十一届全国人大常委会第七次会议通过了《中华人民共和国保险法》（以下简称《保险法》）修订草案。2009年10月1日新修订的《保险法》正式实施。本文从保险合同法定解除权入手，对新修订的《保险法》中关于保险人法定解除权的行使、限制以及完善进行简要论述。

On the Legitimate Right to Terminate the Contract of Insurance

On Feb 28, 2009, the revised draft of the Insurance Law of the People＇s Republic of China （Insurance Law） was passed at the seventh meeting of the standing committee of the eleventh NPC. On Oct 1, 2009, the newly revised Insurance Law officially came into effect. This article started from the legitimate right to terminate the insurance contract, and discussed briefly on the execution, limitation and improvement of the legitimate right to terminate insurance contract referred in the newly revise Insurance Law.
