现场勘查是刑事案件侦查当中的一个重要环节。现场勘查处理的好坏往往成为一起刑事案件成败与否的关键。针对当前现场勘查中存在的问题,必须强调在现场勘查过程中要注意程序问题,以确保程序正义的实现;并且也要充分体现出其保障人权的价值,否则,现场勘查的价值就会逊色很多。

The Scene Investigation, Procedural Justice and Human Rights Safeguard

The scene investigation is an important component in a criminal case detection and the effects of scene investigation always remain the key to solve a criminal case. In view of some currently existing problems in scene investigation, this paper discusses that the problem of procedure must be emphasized in the process of scene investigation so as to guarantee the realization of procedural justice. Meanwhile, the value of human rights safeguard must be fully manifested,otherwise the value of scene investigation will become inferior.
