劳务派遣工人合法权益保障机制的缺失与对策研究

摘    要:由于劳务派遣保障制度不完善,劳务派遣工人的福利待遇、民主权利和身份转制的权益等切身利益很容易受到侵害。要完善劳务派遣工人合法权益的保障机制,应该从规范劳务派遣公司注册程序、明确劳务派遣的适用范围与期限、保证劳务派遣工人的福利和身份转制以及加强监管几个方面落实相应的规章制度。

Research on the Absence and Countermeasures of Protection of Dispatched Workers Legal Rights and Interests

Abstract:As the protection system of labor dispatching is imperfect, dispatched workers'rights such as salary, allowance, democratic rights, and rights of transferring to regular employee are easily harmed. To improve the pro- tection of dispatched workers legal rights, laws and regulations need to be built up to regularize the registration of labor dispatch companies, clarify dispatching job types and working periods, guarantee dispatched workers'welfare and their identity transformation, and reinforce the supervision and control.
