构建和谐——社会主义法律的更高价值追求

党的十六届六中全会把构建社会主义和谐社会作为我国社会主义现代化建设新的战略任务和奋斗目标,也为中国特色的社会主义法律提出了更高的价值追求目标。构建和谐社会必须首先实现社会的公平正义,但和谐要求必需公正,公正未必都能和谐。由于社会矛盾的复杂多样性,法律规范的相对稳定性和滞后性,决定了单纯的公正执法并不能实现和谐。应当以《决定》的精神为准则,在公正执法大前提下,更要注重以人为本,化解矛盾,促进人的心理和谐,用灵活的执法活动弥补法律自身的缺陷,为构建和谐社会自觉做出贡献。

Harmonious Society-Higher Pursuit of Socilalist Law in Value

In the 6th Plenary Session of the 16th Central Committee,the construction of socialist harmonious society is considered as the new strategic task and objective of struggle in the socialist modernization in our country,accordingly promoting higher pursuit in value for the socialist law.To construct harmonious society must achieve social justice in the first place in which harmony requires justice but the reverse cannot hold water.Owing to complexity of the social contradictions and the relative stability and lagging behind of laws and regulations,enforcing law in justice merely cannot achieve harmony.Under the guidance of Determination,with the prerequisite of enforcing law in justice,we should pay more attention to human psychological harmony,flexible law enforcement remedying deficiencies in law,making contribution to the construction of harmonious society.
