析纯经济利益损失在侵权行为法中的规范

纯经济利益是指受害人因他人对其人身权或者有体财产权以外的无形的经济利益的侵害所遭受的损失。传统侵权法对这类利益的保护并不完善,通过对国外立法及相关理论的分析阐述可以看到,加强对纯经济利益损失在侵权法上的保护是必要的,纯经济利益作为权利的一种理应受到侵权法的保护。

On Regulation of Pure Economic Losses in Tort Law

Pure economic losses are the losses of the victims caused by infringers to their body or other intangible economic interest except corporeal property. Traditional protections by the Tort Law are imperfect.Through the analysis and illustration of the relative foreign law and theory,we can see it is necessary to strengthen the protection of pure economic losses in Tort Law.Pure economic losses should be protected by the Tort Law as a right.
