和谐劳动关系视角下劳务派遣用工模式存在的问题及完善

劳务派遣是市场经济体制下人力资源创新配置所衍生出来的一种新型劳动关系,是市场化改革过程中政府、企业、劳动者三方综合选择的结果.多年来,劳务派遣凭借政策鼓励、用工成本低、用工模式灵活多变等取得了迅猛发展,但因其特殊的三方主体关系使得劳务派遣用工在实践中存在许多问题.本文以劳动关系和谐为出发点,总结了国内外规范使用劳务派遣用工模式的成功经验,提出目前我国应严格劳务派遣市场准入制度,强化劳务派遣监督管理机制,以期探索规范、科学的劳务派遣用工模式.

The Problems and Improvements of Labor Dispatching Model from the Perspective of Harmonious Labor Relations

Labor dispatch is a new type of labor relation which is derived from the innovation configuration of human resourcesmanagement under market economy system ;it is the comprehensive selection result of government ,enterprises and workers in market-oriented reform.Over the years,labor dispatch has achieved rapid development with the policies to encourage,low labor costs,theflexible labor modes and so on.But the special relationship between the tripartite body causes some problems of labor dispatch,suchas using too much,equal pay for equal work is hard to realize,the laws and regulations are not enough,occupation development islimited and so on ,so the harmonious labor relationship is facing challenges.In view of the implementation of ＂labor Contract Law＂amendment,this article,takes the harmonious labor relations as the starting point,puts forward some suggestions：to summarize thesuccessful experience in the use of standardized labor dispatch employees at home and abroad,to strictly limited the access of labordispatch market,strengthen the supervision of labor dispatch,in order to exploring the normative,scientific labor dispatching model.
