FAMILY/CHILD JUDICIAL DISPUTE RESOLUTION (JDR)

Institution:Hon. Judge Nancy A. F1atters is a judge in the Provincial Court of Alberta, Family and Youth Court (sitting in Calgary, Alberta, Canada). She designed and implemented the Settlement Conference Pilot Project for the court and conducted all the Pilot Project settlement conferences. She brings an extensive mediation background to the bench. As part of her family and matrimonial law practice, she both mediated disputes and taught mediation principles and skills for many years. She has an LL.M. in Alternative Dispute Resolution from Osgoode Hall Law School, York University, Toronto, Ontario, Canda, and is an adjuct assistant professor of law in the Faculty of Law, University of Calgary.
Abstract:This article outlines the Pilot Project in Pre-trial Judicial Settlement Conferencing in Family and Child Welfare/Protection Matters, which was designed and implemented by the authors, The Honourable Judge Nancy A. Flatters of the Provincial Court of Alberta, Family and Youth Court, at Calgary. The article also outlines the basis, rationale, and development underlying this emerging nontraditional judicial approach to the resolution of these disputes and the resulting settlement outcomes.
