目前中国正处于社会转型时期,这一时期的社会矛盾容易激化。突发事件的背后涉及权力的设计和中央、地方分权的问题。汶川大地震提醒人们不宜过分拔高抗震救灾英雄少年;权衡自然科学与社会科学,万不可忽视社会科学的重要性;在功利浮躁的背景下,尤其警惕诸多隐形的学术腐败等。文章检索了近期中国诸多社会现象,其中透露着深层次的以宪政为基础的法治问题。

On the Reflections of the Rule of Law in Recent China

China,which is in the social transition now, also experiences a period of sharpening social contradictions easily. There are some questions such as the design of the power, the central and local decentralization issues behind emergencies; Wenchuan earthquake reminds us that we should not too overstate heroic juvenile of Earthquake Relief; we must not ignore the importance of the social science, balancing the natural and social sciences; we should guard against a number of invisible academic corruption particularly in the utilitarian impetuous context. Retrieving a number of recent social phenomenon in china, we find that they reveal the deep issues of the rule of law on the constitutional basis.
