论目的确定的推定化

在对于目的犯中的目的的确定过程之中,存在着一种目的确定的推定化的有力主张。本文结合我国学者和日本学者的既有研究,在首先界定了目的确定的推定化与主观要素的客观化之间的相应关系的基础上,指出了对待推定必须既积极又慎重。文章在厘清了推定的概念、特征与要件之后,详细论述了本文意义上的目的确定推定化的三层含义:作为例外的推定、允许反驳的推定和必须限制的推定,在此基础上展开了文章对待目的确定推定化的基本立场。
