暴力干涉婚姻自由罪之“暴力”反思

我国刑法无论在理论界还是实务界都倾向于把暴力干涉婚姻自由罪中的暴力仅限于有形暴力，而将对于干涉婚姻自由所采用的威胁、恐吓等无形暴力排除在外。这无法回应当今人权至上、尊重和保障人权的时代主题。对使用威胁、恐吓等无形暴力干涉婚姻自由且造成严重后果的行为作入罪处理有着充分的法律和伦理依据，但同时也应当注意一些问题。
