| 摘 要： | 在对传统大陆法系抗辩权理论进行介绍的基础上,对提单项下的抗辩权根据其行使主体的不同作出分类研究,即分别论述了承运人、提单持有人和收货人的抗辩权,并对提单项下之抗辩权的理论依据作出归纳。

| Abstract: | In this paper, the writer makes the research on the exception right under the bill of lading according to the difference exertion parties, namely, the carrier, holder of the B/L, and the consignee, on the basis of the traditional theory of the exception right in the continental law system. And the writer, as well, sums up the academic foundation of the exception right under the bill of lading. |
