检察引导侦查的双重检视与改革进路

摘    要:检察引导侦查作为检察制度近年来的重要改革趋势,已经取得了较好的实践效果。目前司法实务中存在着两种基本的检察引导侦查实践模式:内部参与型引导模式与外部监督型引导模式。在具体运行过程中,引导侦查在启动程序和界限方面的任意性、检警衔接的脱节、监督效力的两极分化和"同向损益"的结构失衡风险,都在制约着这项机制的效能发挥。在理论层面,检警一体化无法为检察引导侦查提供合理证成;引导权应当成为检警关系的新型权力分支。对此,从规范运作与配套机制出发,从规范引导范围与界限、强化监督效能、补充侦查说理化改造、对引导权力规范运行的程序性控制以及推进智慧检务建设等方面入手,以期有益于推进这项机制的改革实践。

Double Review and Reform Path of procuratorial Work Guiding Investigation

Abstract:As an important reform trend of procuratorial system in recent years, procuratorial guidance investigation has achieved good practical results. At present, there are two basic modes of procuratorial guidance in judicial practice: internal participatory guidance mode and external supervisory guidance mode. However, in the specific operation process, the effectiveness of this mechanism has been restricted by the arbitrariness of the initiation procedure and boundary, the disconnection between the prosecution and the police, the polarization of the effectiveness of supervision and the structural imbalance risk of "syntropy gains and losses". On the theoretical level, the integration of prosecution and police cannot provide reasonable evidence for procuratorial work guiding investigation;the power of guidance should become a new branch of power in the relationship between prosecution and police. Based on this, starting from the standardization of operation and supporting mechanism, this paper proceeds from the following aspects: standardizing the scope and boundaries of guidance, strengthening the effectiveness of supervision, perfect the rationality of the supplement investigation, procedural control over the standardization of power operation and promoting the construction of intelligent procuratorial service, with a view to advancing the reform practice of this mechanism.
