检察权能新拓:撤案核准的内涵阐释与模式展望——兼论刑事撤案与监察撤案的制度建构

最新修订的《刑事诉讼法》第182条第1款确立了在重大立功或者案件涉及国家重大利益情况下的核准撤案制度,由此提炼出的撤案核准模式是刑事撤案制度发展的重要创新,撤案核准权也是公诉权能的重要延伸。现有刑事撤案制度所确立的自行撤案模式、通知撤案模式、建议撤案模式并未发挥应有的效果,亟待变革。撤案核准模式具有扩展适用的合理性与正当性,因而在刑事撤案与监察撤案的制度建构中,撤案核准模式取代自行撤案模式是撤案制度改革的必由之路,在此基础上,取消建议撤案模式,强化撤案监督,实现撤案制度的法治化转型。
