论买卖合同中的瑕疵担保责任

在买卖合同中出卖人应当保证交付完整无缺的标的物,否则需承担相应的瑕疵担保责任。瑕疵担保责任制度为保护买受人的利益,维护交易秩序发挥着重要作用。但随着经济社会的发展,这一制度日益显现出它的弊端,因此需要从宏观和微观两个方面对我国买卖合同中的瑕疵担保制度进行完善。

On Guarantee Liability for Blemish in Sales Contract

In sales contract, the seller should guarantee to deliver intact subject, otherwise, should bear corresponding liability for blemish. The guarantee system plays an important role in protecting buyer＇ s interests and maintaining trade order. But with the development of economy and soci- ety, this system has increasingly shown its shortcomings; therefore we need to improve the system of guarantee liability for blemish in sales con- tract from the macro and micro two aspects.
