完善我国企业劳动争议调解制度的研究

摘    要:调解是解决劳动争议的最基础的方式,具有快捷、便利和低成本的优势,有利于劳动争议及时有效的处理和和谐劳动关系的构建。我国现行的劳动争议调解制度在解决劳动争议、平息劳动纠纷方面起着重要的作用。但随着改革的不断深化,其存在的立法定位偏低、企业劳动争议调解委员会缺乏独立性、人民调解委员会的劳动争议调解能力欠缺、区域性劳动争议调解组织还缺乏有力的制度保障等缺陷和问题日渐突出。进一步完善劳动争议调解制度的思路是:加强区域性劳动争议调解制度建设,强化政府在其中的主导作用;取消劳动争议的企业内部调解和仲裁调解;提升劳动争议调解的专业化水平;赋予调解协议以法律效力等等。

Abstract:Mediation is the most basic way to solve the problem of labor dispute, with fast, convenient and low cost advantages, and is conducive to timely and effective treatment of dispute and building the harmonious labor relations. China's current labor dispute mediation system plays an im- portant role in settling and quelling labor disputes. But with the continuous deepening of reform, some defects and problems have become increasing- ly prominent, for example, legislative orientation of its existence is low, the enterprise labor dispute mediation committee lack independence, the peo- ple's mediation committee lack capacity of labor dispute mediation, regional labor dispute mediation organizations still lack strong system guaran- tee. The idea To further improve the labor dispute mediation system is: to strengthen regional labor dispute mediation system construction; strengthen the government's leading role; cancel the enterprise internal labor dispute mediation and arbitration of labor dispute mediation; enhance professional level; give the mediation agreement the legal effect, etc..
