合作开发合同项下之物权变动研究

合作开发合同性质依其内容虽有不同,但在涉及房屋所有权原始归属问题上并无差异,衡量各方利益状态,其原始所有权应归属于建筑执照申领人,即使在认定合作开发合同为国有土地使用权转让合同的情况下,依债权形式主义法理,亦不能径行认定由受让方原始取得房屋所有权。

Although there're different opinions on the nature of joint-developing contract,it is the same on initial belonging of the ownership of the house,balancing the benefits of every party.The initial ownership of the house belongs to the people who apply for the certificate of construction.Even in the transference agreement of state-owned land use,we can't conclude that the transferee obtains the initial ownership of the house,according to the jurisprudence of the creditor's rights formalism.
