| 摘 要： | 合同的相对性是古典契约法上的重要原则。随着社会的发展,合同相对性原则在近代受到了来自各个方面的冲击,其中首推第三人利益合同。我国合同法第六十四条也有关于第三人利益合同的规定,但是它仍然坚持合同相对性,不是真正的第三人利益合同。由于第三人利益合同在实践中应用越来越广泛,因此,对其进行深入探讨具有重要的理论与实践意义。

| Abstract: | The relativity principle of a contract was a major principle in classical laws for contracts.As the development of society,the relativity principle of a contract in modern time has been impacted from various aspects.The first is the contract for the third party's benefit.Article 68 in Contract Law prescribes that the contract for the third party's benefit still adheres to the principle of relativity.A thorough study on the contract for the third party's benefit is of theoretical and practical significance. |
