对我国商业贿赂刑事政策的思考

商业贿赂在我国泛滥的原因复杂，既有经济体制转型期的经验不足，也有在旧观念影响下的道德扭曲。商业贿赂刑事政策包括商业贿赂刑事立法政策和商业贿赂刑事司法与执行政策。我国没有定期发布刑事政策的惯例，对于二者，我国有关规定是分散而具体的。为遏制商业贿赂犯罪猖獗的势头，在商业贿赂应然刑事政策选择上，我们必须坚持综合治理的刑事政策和对商业贿赂犯罪“从严惩处”的基本原则，在这个前提下，宽严相济，区别对待。
