| 摘 要： | 我国刑事责任能力理论认为刑事责任能力不仅是犯罪主体的构成要素,也是判断行为人的行为是否构成犯罪的重要因素,从概念、构成要素和影响因素等方面对刑事责任能力进行重新建构,认为刑事责任能力是刑事责任主体的构成要素,也是判断犯罪主体是否能够承担刑事责任的必要条件。

| Abstract: | It is not only one of key elements of subject of crime but also the important factor to judge whether one's own act is crime to ability of Criminal Responsibility in theory of ability of Criminal Responsibility in China. According to concept, key elements and influential factors of ability of Criminal Responsibility, the system of ability of Criminal Responsibility is re-constructed. This article thinks it is not only one of key elements of subject of Criminal Responsibility but also the essential to judge whether subject of crime can endure Criminal Responsibility to ability of Criminal Responsibility. |
