谋利型上访的生成机理及其有效治理简

谋利型上访不仅受传统文化、现行法律制度的影响,更与个人权利的畸形伸张和基层政权的相对疲软有关.基于国家信访局暂停对各省“非正常上访”人次数的排名以及涉诉信访改革试点省份的逐步推开,本文认为,要治理谋利型上访,不仅需要规范信访秩序,明确信访责任,完善利益诉求机制,还需要重新界定信访功能,健全信访代理制度和信访终结机制.

Formation Mechanism of the Profit Petition and Its Effective Measures

The highlight and spread of the profit petition is not only influeneed by the traditional cultures and the existing legal systems,but connected with the abnormal upholding of the individual rig]hts and relatively weak of the grassroots regime.Based on the temporary suspension of the ranking for the number of the people of Improper Petition each province and the gradual headway of the pilot provinces in the reform of the petition involved law,this paper considers, to deal with the profit petition,besides regulating the order,clearing the duties of the petition,improving the mechanism of the interests demand,it also needs remold the petition function,perfect the agency system and the petition end mechanism.
