我国农村土地征收纠纷行政救济机制研究

随着城市化进程的加快,我国在征地领域的纠纷日益增多,迫切需要行之有效的纠纷解决方式。由于我国司法救济存在着难以克服的固有缺陷,因而凸显出行政救济机制的重要性。目前构成我国行政解决机制的行政调解、行政裁决、行政复议和信访等制度的设计还存在法律效力和程序保障不足等问题。因此,应完善各种行政救济途径、构建科学的行政救济体系,建立行政救济机制与其他救济机制的有机衔接,充分发挥行政解决机制在我国农村土地征收中的积极作用。

Research on Administrative Relief Mechanism of Rural Land Expropriation Dispute

With the acceleration of urbanization,land disputes in the field are growing in China,which needs urgent effective resolution.Because of the inherent flaws of judicial relief insurmountable,the importance of administrative relief mechanism is highlighted. There are still some legal and procedural problems in the design of current administrative settlement mechanisms including the administrative mediation,the administrative ruling,the administrative reconsideration,petition and other systems.To play more active roles in the administrative settlement mechanism in rural land expropriation,we should make great effort to improving various administrative remedies ways,building a scientific system of administrative remedies,establishing organic convergence mechanism between administrative relief and other relief mechanisms.
