| 摘 要： | 本文着眼于充分保护“第三者插足”案件中无过错配偶方的合法权益 ,对“第三者”相关问题进行了分析 ,论证了“第三者”承担精神损害赔偿责任的缘由 ,通过对“第三者插足”侵害客体的分析 ,阐述了对现在精神损害赔偿制度的反思。

| Abstract: | In this article ,the author analyze the phenomenon of the third party invading marital consortium. In order to better protect the interests of the victim, the author believe that the third party hurts the victim's marital consortium and the victim can ask the third party for the mental injury compensation according to Civil Law .Finally, the author show a little thoughts about the rules of the mental injury compensation. |
