| 摘 要： | 收容遣送制度在最初的设计上,是一种救济制度,后来演变成一项限制公民基本宪法权利的制度。就内容上来说,其中有关限制人身自由的内容,与我国现行宪法以及有关法律相抵触。在实践中,收容遣送的自由裁量权很大,很多方面缺乏公正性,必须予以废除。

| Abstract: | The system of deporting and accommodating was initially designed to be a relief system. However, it then deviated the original purpose--welfare and relief. As for the contents, especially the specification about restricting personal freedom contradicted with the current constitution and laws concerned. While in practice, since the freedom decision right of accommodating and departing is big, solemn is declining,and fair is lack in many aspects. Therefore, it must be revised. |
