略论行政解释的定位及其规制

行政解释是一个在我国行政法学界尚未引起足够重视的问题。现阶段 ,我国在行政解释方面存在的问题较多 ,其中既有程序方面的问题 ,也有对行政解释本身的定位方面的问题 ;既有事前的行政解释权设定方面的问题 ,也有事后对行政解释权的规范、制约方面的问题。应从宪法、组织法到基本法律层面规范和完善对行政解释权的设定和有关行政解释权运作的程序性规定 ,建立一整套对行政解释权的监督、约束机制 ,并确立行政解释在法律解释制度中的合理定位 ,探索立法解释、司法解释、行政解释合理运作、有效制约的机制。

Simple Discussion About Positioning of Administrative Interpretation and Related Regulations

Administrative interpretation is an issue that has not been attached enough importance to in our country's administrative jurisprudence circle. Many problems exist in the aspect of administrative interpretation currently in our country, including problems of procedures and positioning of administrative interpretation; problems about antecedent establishment of administrative interpretation power, and problems about the standardization and restriction of administrative interpretation power afterwards. We should standardize and improve the establishment of administrative interpretation power and procedural provisions about the exertion of administrative interpretation power in constitution, organic law and basic law, establish a complete set of supervisory and binding mechanism for administrative interpretation power, ascertain the reasonable position of administrative interpretation power in law interpretation system, and explore about the mechanism for the reasonable exertion and effective restriction of legislative interpretation, judicial interpretation and administrative interpretation.
