| 摘 要： | 法院调解制度改革与完善,不能仅仅基于旧有诉讼模式产生的司法实践问题而去怀疑法院调解的价值和现有的调审结构,而应当在转换诉讼模式、建构新的诉讼制度的前提背景下,从法院调解制度的性质去思考和决定该制度的取舍、改革和完善。
