| 摘 要： | 审判过程遇到需要对非诉讼标的的行政确认争议事项进行认定的 ,按照行政确认属于明显重大违法的标准由该案法庭直接对争议事项作出认定 ,否则按照“先行政 ,后民事”的标准行事。

| Abstract: | Something confirmed by administrative orgnazation has always been questioned in civil lawsuit.According to a standard that if Administrative confirmation could be affirmed visibly and great illegal,court will be able to make a confirmation directly.Otherwise,court should obey the rule "Administrative confirmation first,civil trial followed". |
