列宁论社会主义法院的职能性质

法院作为国家政权机构的重要组成部分，必然要反映出国家的本质特性，发挥政治功能。但是法院不仅仅是国家的政权机构，而且法院还是社会关系的调节器。作为社会关系的调节器和正义维护的屏障也必须以追求正义和公正为目标，发挥公共服务职能。列宁认为，苏维埃社会主义法院应当是便于人民接近并有人民参与和行使权力的人民法院，法院的性质和法一样，发挥着统治国家的政治功能和公共服务的社会功能，是人民性、政治性和社会性的统一。
