关于刑法方法理论的问题域探析

我国改革开放30年来，正在实现从近代阶级社会向现代和谐社会的转型。在这一过程中必然伴随着阶级社会的刑法方法向和谐社会的刑法方法的转变，现今刑法学界对于这个问题尚缺乏积极的探索。文章提出了刑法方法理论的本体问题、犯罪论体系的构建方法、犯罪构成符合性判断的方法、刑法的解释方法、刑法适用的价值判断方法、刑法论证方法等作为刑法方法理论的基本问题，期待在这方面开展更为深入系统的研究。

The Question of Criminal Law Method theory

For the 30 years of our country＇ s reform and open policy, our country are transforming from the modern times class society to modern harmonious society. The process must follow the transformation inevitably from the crimimal law direction of class society to the harmonious society. Nowadays the criminal jurisprudence field still lacked the positive exploration regarding this question. This article proposed the criminal law method theory＇s main question, the construction method of crime system, the crime constitution compliance judgment method, the criminal law explanation method, suitable value judgment method of crimimal law, the criminal law proof method and so on, which hopes to carry out the more thorough system＇s research in this aspect.
