| 摘 要： | “职务行为”、“受贿方式”是受贿罪客观方面的重要组成部分。职务行为从主体上看包括本人及他人的职务,从时间上看只指利用现时职务的便利,刑法应增设职前受贿罪和职后受贿罪;受贿方式包括收受、期约、索取等三种。

| Abstract: | Post behaviors" and "Ways of accepting bribe" are important components of objective aspects of a bribery crime. Subjectively, post behaviors include one's own post and others' ones, while timely they only refer to the acts utilizing one's present post conveniences. Therefore, the crimes of bribery before the post duty and after the post duty should be added into the criminal law. Meanwhile the ways of accepting bribery include three types to receive, to make agreements and to demand. |
