| 摘 要： | 在我们的理想中维护治安和保护人权应该是和谐统一的，但是在实际层面，除了和谐统一，维护治安和保护人权在某些时候还表现出矛盾冲突。从不同层面分析两者产生矛盾冲突的原因。以及影响两者博弈的因素，有助于实现和维护两者的均衡状态。
