| 摘 要： | 生态补偿旨在利用衡平原则对保护者和受益者、受害者和施害者之间的与生存权、环境权、发展权等权利相关的利益进行制度协调,从而对已破坏的生态环境给予补偿和恢复,使之能够达到或接近平衡状态,也使与此相关的各个主体之间的利益得以协调,衡平同样是基本权利的生存权、环境权、发展权等权利之间的不和谐和冲突。其法理基础是区域环境公正。

| Abstract: | Eco-system compensation is a system coordinating people s rights and interests on living,environment,development and other spheres.On the one side,it can recover and compensate the destroyed environment,balance the eco-system;on the other side,it also can coordinate interests among corresponding subject,balancing disharmony and conflicts of those rights.Its legal base is just in regional environment. |
