《大清律辑注》按语的类型化解析

《大清律辑注》作为清初注释律学的奠基之作,具有作为律学文本研究对象的典型性。对《大清律辑注》中沈之奇所作的267条按语进行系统的分类整理,并按照概念解释、律例阐释和观点评述三种类型进行较为全面的解析。按语作为律学文本的重要组成部分,既紧密围绕律条注释展开,同时又表达了著者对若干问题的观点立场和理论探索,能够为传统律学文本研究提供一个良好的视角。

The Typological Analyses to Commentaries in the Text of Compilation Annotation of Code in Qing Dynasty

As an annotation law science's magnum opus in the beginning of Qing dynasty,the book of Compilation Annotation of Code in Qing Dynasty is a model,which can be treated a research object of annotation law science texts.In this paper,the 267 pieces of mommentaries in this book writed by Shen Zhi-qi are classified three types,which are the type of ananlyses of concept,the type of explain the meaning of law items,and the type of remarking on viewpoints.On this typological basis,we have an detailed analyses to these three types commentaries.As an important part of annotation law science' text,commentaries have a base of annotation law items,and they also can express author's opinions to some questions and the author's thinking in theory field.The commentaries can offer a good angle of view in the research taditional annotation law science's texts.
